Welcome to our hosting services, including Virtual Private Servers (VPS), web hosting, Virtual Private Networks (VPN), and other related offerings. By accessing or using our services, you agree to be bound by these Terms of Service (“ToS”). If you do not agree with any part of these terms, please refrain from using our services.

1. Acceptance of Terms

By subscribing to or utilizing any of our services, you acknowledge that you have read, understood, and agreed to these ToS, along with our Privacy Policy and Acceptable Use Policy (if applicable). We reserve the right to update or modify these terms at any time, and such changes will be effective upon posting. Continued use of our services after updates constitutes your acceptance of the revised terms.

2. Service Description

We provide a range of hosting solutions, including but not limited to VPS, web hosting, VPN services, and additional support for website management. Service specifications, including resource allocations (e.g., CPU, RAM, storage), bandwidth, and uptime guarantees, are outlined in your service plan or order confirmation. We strive to deliver reliable and high-quality services but do not guarantee uninterrupted or error-free operation.

3. Account and Usage

• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must use our services in compliance with all applicable laws and regulations, including those related to data protection, intellectual property, and online conduct.
• Strict Prohibition on Illegal Activities: Use of our services for illegal activities, including but not limited to hacking, spamming, distributing malware, phishing, engaging in fraudulent schemes, or any other unlawful acts, is strictly prohibited. We reserve the right to immediately suspend or terminate your account upon detection of such activities, and we may report violations to the appropriate legal authorities without prior notice.
• Services are intended for personal or business use as per your subscribed plan. Reselling or sharing accounts without prior written consent is prohibited.
• SMS Delivery Disclaimer: GhostVPS provides Dedicated Virtual Numbers primarily for receiving SMS verifications on various platforms. However, we do not guarantee successful SMS delivery from all services. Certain numbers may be blocked by specific platforms, or message delivery may be restricted due to regional regulations or platform policies. Users are responsible for verifying compatibility with their intended services before purchase.

4. Verified Accounts

• Exclusive Ownership
  All Verified Accounts provided by GhostVPS are delivered as exclusive accounts. Upon delivery, the buyer receives full ownership and control of the account.

• Responsibility of Usage
  The buyer is solely responsible for any misuse, illegal activity, or violation of platform policies. GhostVPS shall not be held liable for account suspension, blocking, or termination resulting from the buyer’s actions.

• Initial Support Only
  Customer support is limited to the initial setup and delivery of the account. Issues arising from misuse, policy violations, or fraudulent activities by the buyer are not covered under support.

• Compliance and Legal Use
  Verified Accounts must only be used for lawful and compliant purposes. Any illegal activities, including but not limited to money laundering or fraudulent transactions, are strictly prohibited and remain the sole responsibility of the buyer.

• No Refund Policy
  Due to the nature of Verified Accounts and the inclusion of verification documents, all sales are final and non-refundable once delivery is confirmed.

• Account Blocking or Suspension
  If an account is blocked or suspended due to the buyer’s actions or policy violations, GhostVPS does not provide replacement, recovery, or compensation.

• Confidentiality of Data
  All documents and verification data are provided solely for account setup. The buyer is responsible for keeping credentials confidential and must not share account details with unauthorized third parties.

• Limitation of Liability
  GhostVPS shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or misuse of Verified Accounts.

5. Payment Terms

• Services are billed according to the payment cycle selected (e.g., monthly, quarterly, annually). Payment is due upon invoice issuance.
• Accepted payment methods are specified during checkout. Failure to pay by the due date will result in immediate suspension of your services. If payment remains outstanding 3 days past the due date, your account will be terminated, and all associated data may be permanently deleted.
• All fees are non-refundable unless otherwise stated in our Refund Policy or required by law.
• Upgrades or additional services may incur extra charges, detailed in your account dashboard.

6. Service Level and Uptime

We aim to provide a minimum uptime of 99.9% for our services, measured monthly. Scheduled maintenance or unforeseen issues may cause temporary downtime. Credits for downtime may be issued at our discretion, subject to a valid claim within 7 days of the incident.

7. Intellectual Property

All content, trademarks, and intellectual property related to our services remain our property or that of our licensors. You retain ownership of your data and content, subject to our rights to process it for service delivery and legal compliance.

8. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services, including data loss or business interruption. Our total liability shall not exceed the amount paid by you for the service in the preceding 12 months.

9. Termination and Suspension

• Either party may terminate the service with 30 days’ written notice, except in cases of breach, where immediate termination may occur.
• We reserve the right to suspend or terminate your account for non-payment (as outlined in Section 4), violation of these ToS (including illegal usage as per Section 3), or security concerns.
• Upon termination, you must download your data within 7 days, after which it may be deleted.

10. Privacy and Data

Your privacy is important to us. We collect and process personal data in accordance with our Privacy Policy, available on our website. By using our services, you consent to such processing for service provision, support, and legal obligations.

11. Special Provisions

• For billing cycles of 3 months or longer, TCP ports 25 and 465 are enabled for VPS services located in Finland, USA, and Germany. For all other locations, these ports remain closed, subject to compliance with applicable usage policies.
• Service delivery will occur immediately or within a maximum of 24 hours from order confirmation. If service activation exceeds 24 hours, you may request a full refund, provided the request is submitted within 7 days of the order date.
• Traffic usage is capped at 20 TB per month per service plan, with overage charges or throttling applied as per your agreement.

12. Governing Law

These ToS are governed by the laws of United Kingdom. Any disputes will be resolved through arbitration or the courts of England and Wales, unless otherwise required by law.
